Terms of Service
Effective date: August 6, 2026
1. Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of the EOM Books software (the "Service"), operated by [Your Company Legal Name, e.g. EOM Books, LLC]("EOM Books," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Description of the service
EOM Books is small-business accounting and bookkeeping software: a general ledger, invoicing, bill management, bank feed connections, reporting, and related tools.
EOM Books is not a licensed accounting firm, tax preparer, law firm, or financial advisor. The Service is a tool to help you record and organize your own financial information — it does not provide accounting, tax, legal, or financial advice, and nothing in the Service should be relied on as such. You are responsible for the accuracy of the data you enter and for consulting a qualified professional (accountant, tax preparer, attorney) for advice specific to your business.
3. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
4. Your data and content
You own the financial data and content you enter into the Service ("Your Data"). You grant us a limited license to host, store, process, and display Your Data solely to provide and improve the Service. You are solely responsible for the accuracy, legality, and completeness of Your Data.
You can export Your Data (e.g., via CSV) at any time through the Service, and may request a copy or deletion by contacting us — see our Privacy Policy.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, including money laundering, fraud, or tax evasion
- Attempt to gain unauthorized access to any part of the Service or another organization's data
- Interfere with or disrupt the integrity or performance of the Service
- Reverse-engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law
- Use the Service to store or transmit malicious code
6. Third-party services
The Service integrates with third parties to provide certain features — including Plaid for bank account connections, a payroll processing partner if and when payroll features are enabled, and, optionally, an AI provider for transaction categorization suggestions. Your use of these integrations is also subject to the applicable third party's own terms and privacy policy. We are not responsible for the acts or omissions of third-party service providers.
7. Fees
[Describe current pricing here — e.g., the Service is currently offered free of charge / in beta. We will provide advance notice before introducing or changing any fees, and continued use after a fee change takes effect constitutes acceptance of the new fees.]
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CALCULATIONS, REPORTS, OR CATEGORIZATION SUGGESTIONS (INCLUDING AI-GENERATED SUGGESTIONS) WILL BE ACCURATE OR COMPLETE. YOU ARE RESPONSIBLE FOR REVIEWING ALL DATA AND REPORTS BEFORE RELYING ON THEM.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, [YOUR COMPANY LEGAL NAME, E.G. EOM BOOKS, LLC] SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, or for any reason with reasonable notice. Upon termination, your right to use the Service ends; certain provisions (data ownership, disclaimers, limitation of liability) survive termination.
11. Changes to these terms
We may update these Terms from time to time. We will post the updated version here with a new effective date; for material changes, we will provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of [State, e.g. Delaware], without regard to its conflict-of-law provisions.
